From the Islamic point of view, men and women are equal before the law.  The woman in Islam is never a victim of injustice.  Islam gives her the right and protection.  There are a lot of people around us who argue that the civil laws of Islam are against women in Islam.  There can be no doubt that they have such a mindset due to misunderstandings.

Women in islam - Equality before the law

Women and men are equal before the law and the courts.  Justice is gender neutral.  The Qur'an imposes the same punishment on both men and women for crimes such as theft (5:38), adultery (24: 2), murder and treason (5:45).

Pure Islam also gives due importance to women in economic matters.  The testimony of women is another issue that is widely misunderstood.

If a man Allege adultery on his wife

According to Islamic law, if a man accuses on his wife of adultery, Islam commands that it be dealt with in the following way. This is how a man should testify on that occasion.

Swear (zusterinislam.com) four times in the name of God that what he said is true.  Fifth, he must say that if what he said is a lie, then may God's curse be upon him.

His wife testifying four times in the name of God that what he said was a lie would save her from punishment.  Fifthly, if what he said is true, then may the curse of God be upon him.(Qur'an 24: 6-9)

The testimony of women and the testimony of men in Islam

There is a verse in the Qur'an which distinguishes between the testimony of women and the testimony of men.  This verse can be examined in its context and in the context of other Qur'anic verses concerning testimony.  "O you who believe, (zusterinislam.com)write down your obligations to one another at regular intervals.  Let someone write it down justly among you, and no writer should refuse to write as God has taught him.  Let him write it down, and let the debtor tell it.  Let him fear the Lord his God, and let him not despise.  But if he is foolish, inefficient, or incapable of speaking, then let the Lord of his hand speak justly for him.  And witness two men from among you.  If two men (if you do not find one among your witnesses, then one man and two women are called - this is a reminder when one goes astray) the witnesses should not refuse, nor should the transaction be small or large, and should not hesitate to set a time limit (Qur'an 2: 282).


  1. The testimony of a woman cannot be used as evidence to argue that there is a general law in Islam that is half the testimony of a man.  This is because the Qur'anic verse (24: 6-9) refutes this argument, showing that the testimony of a man and a woman is equal.
  2. Note that the context of this verse is related to financial transactions.  Transactions are often complex and full of informal styles of business.  It is clear that this verse is not an indiscriminate generalization.  Otherwise, the first quote (24: 6-9) must be quashed.
  3. The reason why two women should testify instead of one man is stated in this verse itself.  Nowhere is it said that the testimony of one class is better or worse than that of another.  The purpose is to verify the testimony of one woman with the testimony of another woman and thereby prevent any misunderstandings that may have arisen in the business sense.
  4. Unlike the pure acts of worship which are to be performed as taught by the Holy Prophet, witness is a means to an end;  The purpose of seeking justice.  It is therefore the duty of a righteous judge to emphasize the administration of justice, regardless of the gender of the witness, when assessing the merits and credibility of the testimony.  The testimony of a woman who graduated from business school is more valuable than the testimony of an illiterate man who has no experience or knowledge in business.  Participation in public affairs Women and men can be partners and co-operate in socio-political spheres.  This is the general law of Islam.

In ancient societies women were generally not closely related or experienced in business dealings.  That is still the case today.  In this context a woman's testimony is confirmed by another woman who was with her to ensure the accuracy of the transaction.  It is also in the interest of justice.  Thought about the merits of women's testimony has no place here.  That must be why great scholars like Twabari upheld the right of women to be promoted even to the highest office of judge.  If any evidence had been found in the Qur'an or in the teachings of the Prophet (peace and blessings of Allaah be upon him) that prevented women from judging the testimony of others, they would not have taken this position.

Believing women and men are collaborators.  They enjoin good and forbid evil.  Prayers are performed regularly and Zakat is paid.  And obey God and his angel.  God will have mercy on such people.  God is invincible and wise.  "(Qur'an 9:71)

There is ample evidence in history that Muslim women participated not only in the election of rulers, public affairs, legislation, administrative positions, education and teaching, but even in war.

Islam has never excluded a woman from Islam from political and legal matters and has given due importance to her views.

As this is a subject that is being misunderstood in a very big way, more discussions need to take place on this topic.It ends for the time being in the hope that we can move forward with more troops.

The laws of Islam are never against women.  Understanding the situation, we can see Islam as a religion that recognizes women more.
